NEAR RIPON, NORTH YORKSHIRE, UNITED KINGDOM — Ask Scaffolding Ltd has been fined £16,000 following the death of trainee scaffolder Michael Swales near Ripon, North Yorkshire. HSE published the prosecution outcome on 6 November 2026, distinguishing the new enforcement announcement from the fatal incident in July 2023.
Unsecured board and absent safe zones
According to HSE, Swales fell five metres on 5 July 2023 after standing on an unsecured board while erecting scaffolding at a housing development. He died at the scene.
The investigation found unsafe erection work, no established safe zones and no harness or lanyard use by either worker involved. HSE also reported missing guardrails identified after the accident and evidence of earlier work departing from industry guidance.
Guilty plea led to fine, costs and surcharge
The Pickering-based company admitted breaching regulation 4(1)(c) of the Work at Height Regulations 2005. Leeds Magistrates’ Court imposed the fine on 4 November 2026, alongside £8,000 costs and a £2,000 victim surcharge. These are court-imposed amounts, not proposed penalties.
HSE Blog Analysis
Scaffold erection creates a changing work environment: protection that is complete for one position may be incomplete at the next. A useful supervision check therefore follows the sequence of assembly rather than inspecting only the finished structure. The key question is what protects the worker during each transition.
For contractors reviewing similar operations, observing a representative erection sequence can reveal whether the planned safe zone actually remains available. Any reliance on personal protection also needs to be workable at the specific position and stage of work. Our overview of scaffolding hazards and protection provides background, while testing risk assessments against real work discusses how to examine the gap between instructions and practice. These are general editorial applications, not additional findings in this prosecution.
